If you remain in the country beyond your authorized date of entry without timely filing an extension application, you will generally begin to accrue a period of unlawful presence. Staying beyond 180 days may result in a three-year bar on re-entry, while staying more than one year may result in a ten-year bar. Filing an application before the deadline allows you to remain in a period of lawful stay while USCIS processes your case.
