STEM OPT Application Approved Despite Lack of Evidence: Successful Response to the Second RFE

The client is a STEM major student with a pending I-765 application for STEM OPT extension. She was previously represented by another firm that helped the client submit her response to the first Request for Evidence (RFE), in which USCIS requested the submission of her complete employment history.

The client came to us with the second RFE that was issued within three months of her response to the first one. In the second RFE, USCIS asked for additional documents related to one of her previous employments – an implication of employment fraud.

During the preparation, the client advised our legal team that she could not provide the requested employment documents. After thoroughly reviewing the client’s previous filings and employment records, our legal team concluded that the client is nonetheless eligible for a STEM OPT extension. We submitted a carefully-drafted attorney letter and supporting documents to prove that the client had not violated the terms of her initial OPT status.

USCIS approved the client’s I-765 application within two weeks of our submission.
