Immigrant Visa Denial Due to CCP Membership

Our client, a devoted U.S. citizen daughter, filed an I-130 petition for her mother with the hope of reuniting in the United States after years of separation. The I-130 petition was swiftly approved by USCIS, and the mother proceeded with the immigrant visa process at the U.S. Consulate in Guangzhou, China.

However, the process took an unexpected turn when the U.S. Consulate in Guangzhou denied the mother’s immigrant visa due to her past membership in the Chinese Communist Party (CCP)—a ground of inadmissibility under U.S. immigration law. Disheartened by the unexpected refusal and desperate for answers, the family turned to the Law Offices of Sabrina Li for guidance.

I-601 waiver under INA §212(a)(3)(D)(iv)

Though the wait lasted nearly three years, our client never gave up hope—and neither did our firm. In 2025, the family finally received the news they had been longing for: the I-601 waiver was approved.

With this major hurdle overcome, the mother can now resume the immigrant visa process at the U.S. Consulate in Guangzhou. Once issued, her visa will allow her to reunite with her daughter in the United States and begin a new chapter of their lives together.

Understanding CCP Inadmissibility and Waivers

Typically, past or present membership or affiliation with the Communist Party, or any totalitarian party, renders an individual inadmissible. Yet, there are exceptions and waiver possibilities, especially for relatives of U.S. citizens or Lawful Permanent Residents (LPRs).

A discretionary waiver is available for certain family members of U.S. citizens or lawful permanent residents (LPRs).To request this waiver, the individual must submit an Application for Waiver of Grounds of Inadmissibility (Form I-601).
