Our client entered the United States with a tourist visa. During her tourist visa application, she represented herself to be married, when she was not, in fact, married. Since entering the United States, our client had married a United States citizen and wanted to know whether she qualified for a green card.

Upon a thorough review of the client’s immigration history, our experienced team was able to determine that our client was inadmissible under INA § 212(a)(6)(C)(i). Under this section of the law, any individual who seeks a visa, other documentation, or admission into the United States by willfully misrepresenting a material fact is inadmissible. This inadmissibility does not have a time limitation. This means that regardless of how many years have passed, the person remains inadmissible unless they are granted a waiver.

Our firm filed an I-130 petition for alien relative and an adjustment of status petition for our client as the spouse of a United States citizen. Our team also filed a waiver for our client’s inadmissibility. In the waiver, we detailed her husband’s elderly age and deteriorating health to prove he needed our client to remain in the United States to care for him.

Everything seemed to go well, and our client’s I-130 petition and waiver were quickly approved in 2021. Our client even attended the adjustment of status interview; however, her adjustment of status stalled due to USCIS delays in workload. Our office did not give up and sent multiple inquiries into the status of our client’s adjustment of status, even involving the USCIS Ombudsman.

Finally, after over two years of waiting, our client was notified that her adjustment of status had been approved. She was over the moon when she finally received her lawful permanent resident card.
